The researcher has done the research on rights of refugees in India. The International Convention dealing with the issue of refugees is the 1951 Convention on Status of Refugees and the 1967 Protocol attached to it. The term 'refugee' is defined as -"…a person owing to well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion, is outside the country of his nationality and is unable or, owing to such fear, is unwilling to avail himself of that protection of that country; or who, not having a nationality and being outside a country of his former habitual residence as a result of such events, is unable or, owing to such fear, unwilling to return to it."The research contains the history of refugees in India and also analyses the problems faced by refugees then in addition to it the researcher has given brief idea about India’s Stance in 1951 Convention, how India entered in the UN in 1951 and the stand of it.Following up what is the refugee status in India is explained through constitutional protection, laws in India and of Judiciary, UNHCR and NHRC in India , International laws and conventions on Refugees and the India’s Refugee Policy.
